Terms of Service
1. Acceptance of Terms
By accessing or using Guardian ("the Service"), operated by Red Impact LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not access the Service.
2. Description of Service
Guardian is an automated security scanning service that analyzes web applications for common vulnerabilities. The Service provides findings reports for informational purposes only. Guardian is not a substitute for professional security audits. Results are probabilistic and may include false positives or miss certain vulnerability classes.
3. Permitted Use
You may only scan applications and domains that you own or have explicit written permission to test. Unauthorized scanning of third-party systems is strictly prohibited and may violate the Computer Fraud and Abuse Act (CFAA) and similar laws. You agree not to use the Service for any illegal purpose or to scan systems without authorization. Violation of this section may result in immediate account termination and referral to law enforcement.
4. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account. You agree to notify us immediately of any unauthorized use at support@tryguardian.dev.
5. Subscription Plans and Billing
Guardian offers subscription plans billed monthly or annually in advance. All prices are in USD and exclusive of applicable taxes. Payments are processed securely by Stripe, Inc. By providing payment information, you authorize us to charge your payment method on a recurring basis. Your subscription renews automatically at the end of each billing period unless cancelled. We reserve the right to change pricing with 30 days' notice to registered users.
6. Cancellation and Refunds
You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not provide refunds for partial monthly billing periods. Annual plan purchases are eligible for a full refund within 14 days of the initial purchase date. 7. Rate Limits and Fair Use
The Service enforces rate limits to ensure fair access for all users. Plans have scan limits as described on the pricing page. Attempting to circumvent these limits through technical means may result in account suspension.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. GUARDIAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL VULNERABILITIES IN YOUR APPLICATION WILL BE DETECTED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RED IMPACT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless Red Impact LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Data Retention
Scan results are stored for 90 days from the scan date. You may delete your scan history at any time from the Scan History page. Account data is retained for 30 days after account deletion, after which it is permanently deleted.
12. Intellectual Property
The Service, including its software, design, content, and trademarks, is owned by Red Impact LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes only.
13. Modifications
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email to registered users. Continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our sole discretion. You may terminate your account at any time from the Settings page.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law provisions. Any dispute arising under these Terms shall be resolved by binding arbitration in Sheridan County, Wyoming, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
